1. The agreement and how it changes

These Terms of Use (“Terms”) are a contract between you and KAELITHURMN DORNSHIOP (“we”, “us”, “the studio”) for use of mobile applications and related services we publish (the “Apps”). By downloading, installing, or using an App, you agree to these Terms and our Privacy Policy.

We may update these Terms. If a change materially reduces your rights, we will provide at least 15 days’ notice in the App or on donshop.date before the change takes effect, where reasonably practicable. Continued use after the effective date constitutes acceptance of the updated Terms. If you do not agree, stop using the Apps and uninstall them.

2. Who may use the Apps

You must be at least 13 years old (or the higher minimum age required in your country) to use the Apps. If you are under the age of legal majority where you live, you may use the Apps only with permission of a parent or guardian. Apps with user-generated content or dating/social features may require a higher age (for example 18+); those Apps will state the higher age in their listing or in-app notice.

3. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Apps on devices you own or control, solely for your personal, non-commercial use, in accordance with these Terms and the applicable store rules. You may not copy, modify, distribute, sell, rent, reverse engineer (except where mandatory law allows), or circumvent security or billing features of the Apps.

4. Acceptable use

You agree not to:

• Use the Apps for unlawful, harmful, fraudulent, or abusive purposes;
• Interfere with or disrupt the Apps, servers, or networks;
• Attempt unauthorized access to accounts, systems, or data;
• Use automated means to scrape or overload the Apps except as allowed by robots rules or written permission;
• Misrepresent your identity or affiliation;
• Upload malware or content that infringes others’ rights.

We may suspend or terminate access if we reasonably believe you violated these Terms.

5. Our intellectual property

The Apps, including software, design, text, graphics, logos, and trademarks, are owned by KAELITHURMN DORNSHIOP or our licensors. These Terms do not transfer ownership to you. Feedback you send may be used by us without obligation to you.

6. Purchases, subscriptions and refunds

Some Apps offer in-app purchases or subscriptions. Payments are processed by Apple (App Store) or Google (Google Play), who are the merchant of record for those transactions. Prices, taxes, renewal periods, and cancellation controls are shown in the store before you buy.

• Subscriptions: Unless you cancel, paid subscriptions may renew automatically at the end of each period. Manage or cancel in your Apple ID or Google Play account settings.
• Refunds: Refunds are handled under Apple’s or Google’s policies. For Google Play, refunds may be available within a limited window (for example 48 hours) via the store; after that you may contact us and we will consider requests in line with store rules and applicable law. We do not state “no refunds” in absolute terms where consumer law or store policy requires otherwise.
• We do not receive your full payment card details.

7. If you are a consumer in the EEA, the UK or Switzerland

Nothing in these Terms limits mandatory consumer rights that cannot be waived. You may have a 14-day right of withdrawal for distance contracts. For digital content, that right may be lost if you expressly consent to immediate performance and acknowledge that you lose the withdrawal right, and we provide confirmation as required by law.

Unfair terms are not binding. You may bring claims in the courts of your place of residence where mandatory law so provides.

8. Advertising

Free versions of some Apps may display advertising. Ad partners may process device and advertising identifiers as described in our Privacy Policy. You can adjust personalized ads through OS settings and, where available, in-app privacy options.

9. Third-party services

The Apps may link to or integrate third-party services (maps, cloud providers, stores, analytics). Those services are governed by their own terms and privacy policies. We are not responsible for third-party services we do not control.

10. Availability, updates and ending the agreement

We aim to keep the Apps available but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features. We may provide updates that you should install for security and compatibility.

You may stop using an App at any time by uninstalling it. We may end or suspend the licence if you breach these Terms or if we discontinue the App. Provisions that by nature should survive (including intellectual property, disclaimers, liability limits, and governing law) will survive termination.

11. Disclaimers

THE APPS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPS WILL BE ERROR-FREE, SECURE, OR MEET YOUR SPECIFIC REQUIREMENTS.

Unless an App is expressly offered as a regulated medical device, our Apps are not medical devices and do not provide medical, legal, or financial advice. Always seek qualified professional advice where appropriate.

Some utilities perform operations that can change or delete files or settings on your device. Back up important data before bulk or destructive operations.

12. Limitation of liability

To the maximum extent permitted by law, KAELITHURMN DORNSHIOP and its directors, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising from your use of the Apps.

Our total aggregate liability for claims relating to an App will not exceed the greater of (a) the amount you paid us for that App in the 12 months before the claim, or (b) 50 USD — except where mandatory law prohibits such a limit (including liability for death or personal injury caused by negligence, fraud, or other non-excludable liability).

13. Indemnity

You agree to indemnify and hold harmless KAELITHURMN DORNSHIOP from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Apps or violation of these Terms or third-party rights, to the extent permitted by law and except where caused by our willful misconduct or gross negligence.

14. Governing law and disputes

These Terms are governed by the laws of Hong Kong, excluding conflict-of-law rules, except that mandatory consumer protections of your country of residence continue to apply if you are a consumer.

Courts of Hong Kong have non-exclusive jurisdiction, without prejudice to your right as a consumer to bring proceedings in your place of residence where required by law.

15. Copyright complaints

If you believe content in an App infringes your copyright, contact support@donshop.date with: your contact details, a description of the work, the location of the allegedly infringing material, and a statement made in good faith that use is not authorized.

16. App Store and Google Play

If you downloaded an App from Apple’s App Store or Google Play, you acknowledge that:

• These Terms are between you and KAELITHURMN DORNSHIOP, not Apple or Google;
• Apple and Google are not responsible for the App or its content, maintenance, or support (except as required by their store rules);
• Apple and Google are third-party beneficiaries of these Terms with respect to their store rules and may enforce them;
• You must comply with applicable Usage Rules set out in the Apple Media Services Terms or Google Play Terms of Service.

17. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms are the entire agreement between you and us regarding the Apps, superseding prior agreements on the same subject. The English language version controls if translations conflict.
